There are different types of cookies, based on the characteristics and functions, which can remain in the user’s computer or mobile device for different periods of time: temporary (or session) cookies, deleted as soon as the browser is closed; persistent cookies, they will remain on the user’s device until a preset expiration time.
According to applicable Italian legislation, use of cookies is not subject to express consent by the user. In particular, the so-called “Technical cookies” – i.e. those used only to send a communication to an electronic communication network, or as strictly necessary to provide a service expressly requested by a user – do not require a consent.
In other words, those are cookies necessary for the website’s functioning or necessary to perform the activities requested by the user.
Amongst the technical cookies, the use of which does not require an express consent, the Italian Data Protection Authority includes also:
- browsing and session cookies (for the authentication);
- “analytics” cookies, where used directly by the website manager to collect information, in an aggregated way, about the number of users and how they visit the website itself;
- functionality cookies, which allow the user’s browsing on the basis of a set of selected criteria (such as the language, the product selected for purchase) in order to improve the service rendered to the latter.
On the contrary, for the „profiling cookies”, i.e. those necessary to create user’s profiles and used to send advertising messages consistent with the preferences expressed by the user during the browsing, the prior user’s consent is requested.
